Terms and
conditions.

The terms on which you use Upshift and pay Monoform. Written to be read, not to be survived.

01 — Who we are

Monoform

Monoform (Pty) Ltd is a software company registered in South Africa, at 11 Nantes Street, Paarl, Western Cape. We build custom software and AI automation for businesses, and we operate Upshift, a subscription service for automotive workshops. Reach us at rassie@monoform.co.za or 082 854 7888.

02 — What these cover

The agreement between us

These terms apply when you use Upshift, and to any Monoform service you pay for through this website. By creating an account or making a payment you accept them. If you are agreeing on behalf of a business, you confirm you are entitled to do so.

03 — Your account

Keeping it yours

You give accurate details when you sign up, you choose your own password, and you keep it to yourself. Monoform never asks for your password. You are responsible for what the users you invite do in your workshop's account. Tell us promptly if you think someone has gained access who should not have.

04 — The free trial

Fourteen days, at no charge

New workshops get fourteen days free. A payment card is required to begin the trial so that service continues without a gap, but no amount is charged during it. If you cancel before the fourteen days are up, you are charged nothing at all.

05 — Fees

R799 per month, per workshop

The Workshop plan is R799 per month in South African Rand. The first charge is taken on the day the free trial ends, and monthly on that date afterwards. Every charge is listed in Settings → Billing inside Upshift. If we change the price we will tell you by email at least 30 days beforehand, and you may cancel before it takes effect.

06 — Payment

How the money moves

Card payments are processed by a registered South African payment gateway over an encrypted connection. The gateway tokenises your card: Monoform does not see, handle or store your card number. If a payment fails we will retry and let you know; if it keeps failing we may suspend access until it is settled.

07 — Cancelling

Any time, by you

Cancel in Settings → Billing whenever you like, without asking anyone. You keep full access until the end of the period you have already paid for, and nothing further is charged. Refunds are covered in the refund and cancellation policy.

08 — Suspension

When we can stop the service

We may suspend or close an account for unpaid fees after notice, for unlawful use, or for behaviour that puts the service or other customers at risk. Except where the law requires otherwise, we will give you reasonable notice and a chance to put it right, and you may export your data before closure.

09 — Your data

It stays yours

The records you put into Upshift belong to you. We process them only to run the service for you, in line with our privacy policy and the Protection of Personal Information Act. You can export your data at any time while your account is open. After an account closes we keep it for 60 days so it can be recovered, then delete it, apart from anything we must retain by law.

10 — Availability

What we promise, honestly

We work to keep Upshift available and backed up, but no online service runs without interruption. We may take it down briefly for maintenance and will avoid working hours where we can. We do not promise uninterrupted or error-free service.

11 — Acceptable use

The short list

Do not use the service unlawfully, do not attempt to break into it or disrupt it, do not resell or rent access to it, and do not copy or reverse engineer the software.

12 — Intellectual property

Who owns what

The Upshift software, its design and its underlying code remain the property of Monoform. You get a right to use the service for your own business while your subscription is current. Your business data remains yours throughout.

13 — Liability

The limits

To the extent the law allows, Monoform's total liability arising from the service is limited to the fees you paid in the three months before the claim, and we are not liable for indirect or consequential loss such as lost profits. Nothing here excludes liability that cannot lawfully be excluded, including your rights under the Consumer Protection Act.

14 — Changes

To the service and these terms

We may change the service and these terms. Material changes will be sent to you by email or shown in the application before they take effect. Continuing to use the service afterwards means you accept them; if you would rather not, you may cancel.

15 — Governing law

South Africa

These terms are governed by South African law, and the South African courts have jurisdiction. Your rights under the Consumer Protection Act and the Electronic Communications and Transactions Act are not affected by anything written here.
